Our Take on Privacy
Here's our take on privacy:
Voting is a sensitive issue and we want to respect (and protect) your privacy. You can choose from the following three privacy options, and you can change your choice whenever you like:
- Private. If you choose to be private, no one (not even your Facebook friends) will know what your opinions are. You'll have the option to grant and revoke access individually. If friends search for you by name or email, or follow a link to your profile, they'll see that you are a Circle Voting user and they will be able to request permission to access your opinions.
- Friends Only. Only your Facebook and Twitter friends will be able to see your opinions. You'll see each others' opinions automatically, and you and your Facebook friends will automatically be included in each others' circles. You can revoke access from any particular friends individually. If people outside your network search for you by name or email, or follow a link to your profile, they'll see that you are a Circle Voting user and they will be able to request permission to access your opinions.
- Public. This option gives you the greatest potential to multiply your vote and have your opinions heard. When you are public, your profile and all your opinions will be accessible to all Circle Voting users. You and your Facebook friends will automatically be included in each others' circles.
Regardless of which option you choose, Circle Voting will never share or sell personal identification information such as your email or mailing address, passwords and other login information except in the circumstances outlined below.
Circle Voting Privacy Policy
Set forth below is the privacy policy for Circle Voting, Inc. (“Circle Voting”). By visiting or using any of Circle Voting's websites, including www.circlevoting.com, you hereby accept, and agree to, the following privacy policy (the “Privacy Policy”):

Data Collection.
- If you visit Circle Voting's website, your web-browser automatically Discloses, and our web-server automatically logs, the following information: the date and time, the IP address from which you issued the request, the type of browser and operating system you are using, the URL of any page that referred you to the page, the URL you requested, and whether your request was successful. This data may or may not be sufficient to identify you.
- Any additional data that you provide, e.g. in a web-form, may also be logged. This data may or may not be sufficient to identify you.
- Any additional data that your web-browser automatically provides may also be logged. This will be the case, for example, if your browser has previously been requested to store data on your computer in 'cookies' and submits them each time you request a web-page within a particular domain. This data may or may not be sufficient to identify you.
- If you Disclose personal data to Circle Voting, it will become part of Your Data (as defined below), and Circle Voting will collect it. Moreover, any data that becomes available to us through any of the means described above in this Section 1 may be able to be associated with you, and hence become part of Your Data.

Data Disclosure.

Disclosure Options. Voting is a sensitive issue, and Circle Voting is committed to respecting and protecting your privacy. With regard to the Disclosure of any opinions that you post with Circle Voting (the “Posted Opinions”) and the members of your Circle Voting community (your “Circle”), you can choose from the following three disclosure options, and you can revise your choice whenever you like.
- Private. If you choose the “Private” disclosure option, Circle Voting will not associate your name with any of your Posted Opinions or allow any other user to join your Circle. If another Circle Voting user finds you on Circle Voting, such user will be (A) informed that you are a Circle Voting user and (B) invited to request permission to access your Posted Opinions and join your Circle. Upon receiving such a request, you have the option to grant or deny it. If you grant such permission to such user, such user will have access to your Posted Opinions and be included in your Circle. You may subsequently revoke such permission.
- Friends Only. If you choose the “Friends Only” disclosure option, (A) your Facebook and Twitter Friends (as “Friends” are defined by Facebook and Twitter respectively) will be able to access your Posted Opinions and will automatically be included in your Circle and (B) all other Circle Voting users, who are not your Facebook or Twitter Friends, will have to seek permission to access your Posted Opinions or join your Circle pursuant to the procedure set forth in Section 2(a)(i) above. You may subsequently revoke any Friend’s access to your Posted Opinions and Circle.
- Public. If you choose the “Public” disclosure option, (A) all Circle Voting users will have access to your Posted Opinions; (B) your Facebook and Twitter Friends will automatically be included in your Circle; and (C) all other Circle Voting users, who are not your Facebook or Twitter Friends, will have to obtain your permission in order to join your Circle pursuant to the procedure set forth in Section 2(a)(i) above.
- General Protections. Subject to the other provisions of this Section 2, Circle Voting will not knowingly allow Disclosure of your Data to any third-party; provided however, that in the event that Circle Voting sends you an email, such email may pass through third-party systems or servers, which Circle Voting does not control.

Required Disclosure. Notwithstanding Sections 2(a) and (b), Circle Voting will Disclose Your Data in the following instances:
- In the course of business being conducted between you and Circle Voting. For example, if you place an order to purchase an item with a credit card, Circle Voting transmits the entire credit card number and any other required information to the appropriate credit card company during the corresponding order processing; provided however, that Circle Voting only shares such information to the extent necessary to conduct the corresponding transaction.
- To the extent required by law, such as a court order, search warrant, or subpoena.

Third-Party Advertisers.
- Circle Voting's website includes third-party advertising and links to other websites. Circle Voting does not directly provide any personally identifiable customer information to these advertisers or third-party websites.
- These third-party websites and advertisers, or Internet advertising companies working on their behalf, sometimes use technology to send (or "serve") the advertisements that appear on our website directly to your browser. They automatically receive your IP address when this happens. They may also use cookies, JavaScript, web-beacons (also known as action tags or single-pixel gifs), and other technologies to measure the effectiveness of their ads and to personalize advertising content. Circle Voting does not have access to, or control over, cookies or other features that they may use. This Privacy Policy does not cover the information practices of these advertisers and third-party websites. Please contact them directly for more information about their privacy practices. In addition, the Network Advertising Initiative offers useful information about Internet advertising companies (also called "ad networks" or "network advertisers").
- Circle Voting may also display personalized third-party advertising based on personal information about you. Although Circle Voting does not provide any personal information to advertisers, such advertisers (including ad-serving companies) may assume that users who interact with or click on a personalized advertisement meet their criteria to personalize the ad (for example, users in the northwestern United States who bought or browsed for a certain good or service).
- Data Retention. Your Data may be retained in Circle Voting's logs, records, backups, and audit trails.

Handling of Inquiries, General Concerns and Complaints.
- If you have inquiries, general concerns, or complaints about this Privacy Policy, or about Circle Voting's behavior in relation to this Privacy Policy, you hereby agree to communicate them (i) solely to Circle Voting, (ii) in sufficient detail, and (iii) solely through a channel made available by Circle Voting for such purpose.
- Circle Voting hereby agrees to provide one or more channels for communications to Circle Voting.
- Unless specified otherwise in the future, any notice to be delivered to Circle Voting in connection with this Privacy Policy should be sent to info@circlevoting.com.
- You hereby agree not to pursue Circle Voting through any means, including regulatory agencies, the courts, or the media (i) unless and until Circle Voting has had a minimum of 90 days to respond to the initial communication delivered pursuant to Section 4(c) above or (ii) while you and Circle Voting are conducting a dialogue regarding the matter.

Definitions.
- The term “Your Data” means data that is capable of being associated with you, whether or not it includes an explicit identifier such as your name or customer number. In particular, it encompasses all data that Circle Voting is capable of correlating with you, using such means as server-logs and cookie-contents. The term “Your Data” does not refer to data that can no longer be associated with you, including aggregated data that does not and cannot identify your data as included in such aggregation.
- The terms “Disclose” and “Disclosure” refer to making Your Data available to any party other than you and Circle Voting and may include many different conditions of data transfer, including selling, renting, trading, sharing and giving.
